Terms of Service

These Terms of Service ("Terms") govern your use of Shopify applications and services provided by Tempered Tools ("we", "our", or "us"), a subsidiary of Fire Burns Up Inc. By installing or using our applications, you agree to these Terms.

1. Acceptance of Terms

By installing any Tempered Tools application from the Shopify App Store, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use our applications.

2. Description of Services

Tempered Tools provides Shopify applications that enhance store functionality, including but not limited to:

• Theme cleanup and optimization tools
• Performance monitoring solutions
• Product review systems
• Accessibility compliance tools
• Headless commerce components and APIs
• Customer notification systems

3. Account and Store Requirements

To use our applications, you must:

• Have an active Shopify store
• Have authority to accept these Terms on behalf of your store
• Provide accurate and complete information during installation
• Maintain the security of your Shopify account credentials

4. Billing and Payment

All billing for our applications is processed through Shopify's billing system. By subscribing to a paid plan:

• You authorize Shopify to charge your payment method on our behalf
• Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected)
• Prices are as displayed at the time of installation and may be updated with 30 days notice
• Refunds are handled according to Shopify's refund policies

We commit to transparent pricing with no hidden fees. The price you see at installation is the price you pay.

5. Free Trials

Some applications offer free trial periods. During a free trial:

• You have full access to the features included in your plan
• You will not be charged until the trial period ends
• You may cancel at any time during the trial without charge
• If you do not cancel, your subscription will automatically convert to a paid plan

6. Acceptable Use

You agree not to:

• Use our applications for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from our applications (except for open-source components under their respective licenses)
• Interfere with or disrupt the integrity or performance of our applications
• Use our applications to transmit malware, spam, or harmful content
• Exceed reasonable usage limits or abuse API endpoints
• Resell or redistribute our applications without authorization

7. Intellectual Property

Our applications and their original content, features, and functionality are owned by Fire Burns Up Inc. and are protected by international copyright, trademark, and other intellectual property laws.

Open-source components (such as our npm packages) are provided under the MIT License and are subject to their respective license terms.

8. Clean Uninstall Commitment

We commit to a clean uninstall process. When you uninstall any Tempered Tools application:

• All code injected into your theme will be completely removed
• No orphaned scripts, stylesheets, or snippets will remain
• Your store data will be deleted from our systems within 30 days
• Metafields created by our apps will be clearly documented

9. Service Availability

We strive to maintain high availability for all our applications. However:

• We do not guarantee 100% uptime and may have scheduled maintenance windows
• Service may be affected by factors outside our control, including Shopify platform issues
• We will make reasonable efforts to notify you of planned maintenance

10. Limitation of Liability

To the maximum extent permitted by law, Tempered Tools and Fire Burns Up Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claims arising from these Terms or your use of our applications shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Tempered Tools, Fire Burns Up Inc., and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our applications or violation of these Terms.

13. Termination

We may terminate or suspend your access to our applications immediately, without prior notice, for any breach of these Terms. Upon termination:

• Your right to use the application ceases immediately
• We will remove any code from your theme
• We may delete your data according to our data retention policies

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by sending a notification through the Shopify admin or email.

Your continued use of our applications after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fire Burns Up Inc. is incorporated, without regard to its conflict of law provisions.
